Tet fined EUR 10,025 for consumer rights violation

The Public Utilities Regulatory Commission (SPRK) has imposed a fine of EUR 10 025 on Tet Ltd for violation of end-user rights, SPRK said July 22.

 Earlier this year, the company had sent notifications of planned contract amendments with a shorter deadline than at least one month before the contract amendments came into force. Tet had sent the notices to 108,445 customers between February 27 and May 24 this year.

Ivars Tauniņš, Director of the Electronic Communications and Postal Department of the SPRK, explained that the operator may make unilateral amendments to the electronic communications services contract, but the end-user must be informed about the amendments and the right to terminate the contract without penalty at least one month before the amendments enter into force.

"This time limit is set to ensure that the end-user's right to terminate the contract is respected before the planned amendments, including an increase in the price of the service or a change in its scope, come into effect. Tet informed end-users about the planned amendments to the contract on average 27-30 days before their entry into force, thus also benefiting materially from the earlier entry into force of the contract," said Tauniņš.

Tet has the right to appeal against the SPRK Board's decision within 10 working days. If the appeal is not lodged, the fine paid will be transferred to the State budget.

SPRK invited end-users of electronic communications to familiarize themselves with their rights in the event of unilateral changes to the terms of a contract by an electronic communications provider.
