Access road blocked after road repairs in Latvia

Latvian Television's 4. studija has reported on yet another dispute that could have been nipped in the bud. According to the broadcast, after road repairs, a landowner can no longer get to their plot of land.

Following the repair of a section of the A6 motorway in 2021, protective barriers were installed at kilometer 44 and as a result, access to the adjacent land is no longer possible. The owner has been advised to create an access road through the neighboring plot, but its owner refuses. 

After the installation of the protective barrier, the owners without access approached Latvian State Roads, who explained that a project and a new access road from the exit of the property "Austrumi" should be built.

But "the owner is categorically against me building an exit road there, [...] I physically do not have access to my property," said Valdis Pīterāns, the owner.

"As a result, not only can I not build anything on the property, I can't even manage it. This includes cleaning up the Daugava river bank, or accessing it with machinery to cut the grass," he added.

"Latvijas Valsts ceļi explained that the previous road was cut off because this section of the Daugavpils highway (A6) has two lanes with heavy traffic and "creating a new connection in this situation contradicts traffic safety principles and will endanger all road users". 

The old road is not registered in the National Register of Road Connections and does not constitute official access to the property.

Latvian State Roads points out that the connection is to be made through the neighboring property. Unfortunately, the problem arises because the neighbor does not agree to make the connection. If the owners cannot agree, it is possible to propose the creation of a road easement. 

In order to create an access road,the owners should apply to the municipality on the basis of the Civil Law which deals with such cases, namely the "Regulations on municipal spatial development planning documents", determining the appropriate layout of traffic infrastructure for the use of the territory, Latvian State Roads explains.
