The IDB found that an official of the State Border Guard, while performing duties, imported a third-country citizen into Latvia with prior agreement. The official received a bribe of several thousand US dollars.
The criminal offense has been referred to the Prosecutor's Office with a proposal to initiate criminal proceedings regarding the illegal movement of a person across the State border if they have been committed by a public official, using its official position, or a group of persons according to a prior agreement (Section 285, Paragraph two of the Criminal Law), as well as for accepting a bribe, committed by a public official personally or through an intermediary before the commission or omission of a lawful or illegal act by using his or her official position (Section 320, Paragraph two of the Criminal Law).
After the incident, the official shall not continue the service at the State Border Guard.
At the same time, the IDB proposes to prosecute the third-country national for the illegal transfer of a person across the State border in a group of persons following a previous agreement (Section 285, Paragraph two of the Criminal Law), as well as for bribery mediation (Section 322, Paragraph one of the Criminal Law).
The IDB reiterated that all persons are innocent until proven guilty in accordance with the procedures of the Law.
