The protest was submitted regarding the judgment of January 24 this year and the decision taken by the court. The Prosecutor's Office has identified serious offenses of the Criminal Law and Criminal Proceedings Law.
In the submitted cassation protest, prosecutors request the annulment of the judgment in the part concerning the exclusion of certain sections of the prosecution from the accused engineer's charge, as well as of the sentence, considering that the accused is subject to the maximum penalty prescribed by law.
Prosecutors also ask for the annulment of the judgment in part on the acquittal of four defendants for violating construction rules and for murder by negligence.
Prosecutors also request the annulment of the judgment in part on the acquittal of two persons in the prosecution for failure to fulfil the duties of a public official, where serious consequences have been caused, as well as the acquittal of one person in the prosecution for violation of labor protection rules, if it has caused the death of a person or serious personal injury to several people.
The court started hearing the Zolitūde case in December 2015, two years after the tragedy happened. It took the judges nine months to prepare a full court ruling on the Zolitūde tragedy. The court decision says that the building construction engineer Ivars Sergets violated construction norms, as a result of which the supermarket "Maxima" collapsed. He was convicted of homicide by negligence by the court and was sentenced to six months in prison. All other accused were acquitted. The building that collapsed had previously won architectural awards and was notable for a garden constructed on the roof.
