The police have handed over the criminal proceedings to the prosecutor's office for prosecution against one person for manslaughter by negligence, the VP said.
On December 13, 2023, a man born in 1941 was injured and died when ice fell from an apartment building in the Latgale suburb of Rīga.
In connection with the incident, during the investigation, the Riga Eastern Regional Directorate of the Riga Regional Directorate of the State Prosecutor's Office re-classified the criminal proceedings under Article 123(1) of the Criminal Law - for unlawful killing by negligence. For such a crime, the law provides for imprisonment for up to three years or temporary imprisonment, probation supervision, or community service.
One person was found to be a suspect for violating Paragraph 3 and Paragraph 12.1.3 of Riga City Council Binding Regulation No 146 - Binding Regulations on the Maintenance of the Territory and Structures of Riga City.
Namely, as the responsible person, he had failed to ensure that snow and ice were removed from the roof of the building and that icicles were removed to prevent them from falling from the roof.
The suspect was placed under a security measure - notification of change of residence.
The police reiterate that all are presumed innocent until proven guilty.
