The PTAC said that, at the end of the proceedings in the current administrative case, a decision taken by the PTAC in December 2020 on the infringement of the collective interests of consumers is now in force.
In December 2020, PTAC imposed a €15,000 penalty on Memory Water, a controversial seller of "structured" water that supposedly increases "bio-energy" levels, for the implementation of unfair commercial practices, but the company appealed against it. LTV's “De facto” reported that the company's “BIO water” came from the same spot where water is taken from the Daugmale residential houses, while the description of the water-structuring technology consists of pseudo-scientific and esoteric statements.
The PTAC decision prohibited the implementation of Memory Water's unfair commercial practices in the form of misleading information on the characteristics and quality of the product “BIO water”, as well as the provision of misleading information on water treatment technology and the quality label.
For these infringements, PTAC imposed a fine of EUR 15,000 on the company, but it challenged the decision before the court, requesting that it be abolished and that the company be compensated for the financial damage of EUR 250,000.
Both the Court of First and Second Instance rejected the request for annulment of the PTAC decision.
