'Dzintars' trademark dispute gets final ruling

The Department of Civil Affairs of the Supreme Court has decided not to continue legal proceedings in a wrangle over the the rights to the "Dzintars" trademark, the court announced September 21. 

Dzintars (meaning "amber") is a well-known cosmetics brand in Latvia and existed as a popular brand name even through the period of Soviet occupation and state ownership. In 1991 was reconstituted as a joint stock company.

In 2019, Dzintars faced insolvency and went bankrupt. Dzintars' assets were purchased by Skinest Group company SIA Ritrem for 5.5 million euros, but the ultimate beneficiary is the Estonian businessman Oleg Ossinovski, LETA reported.

The dispute arose in February 2020, when the administrator of the insolvent joint-stock company "Dzintars" filed a lawsuit in court against the former owner and chairman of the board, Ilja Gerčikovs. The dispute was about the validity of transactions with which the international trademarks "Dzintars" and "Future Formula" were expropriated without compensation. 

Both the court of first instance and the court of appeal granted the claim. Thus, the judgment of the previous court instance, by which JSC "Dzintars" restores the property rights to the relevant trademark, remains valid.

"The Senate had no obvious reason to believe that the outcome of the case contained in the appealed judgment is incorrect and that the case under consideration is of fundamental importance in ensuring uniform judicial practice or further development of law," the statement said.

The decision of the Senate is not subject to appeal.

The origins of Dzintars cosmetics can be traced back to 1849, when Heinrich Adolf Brieger founded a soap and perfumery factory in Rīga, which later became one of the largest cosmetics manufacturers in Latvia.
