According to the opinion of the law firm “Ellex Kļaviņš”, the fact that the previous board of the Stradins hospital did not ensure the timely performance of the contract by LLC Velve as well as the delay in unilaterally terminating the contract "could be considered to be inconsistent with appropriate behavior of a careful landowner".
According to the experts, the board of directors of Stradins Hospital had a legal basis to unilaterally withdraw from the contract since June 2023, because it was clear that LLC Velve would not be able to perform the contract within the specified time period. The decision of the former board not to terminate the contract and to continue it has had a negative impact on the construction of the site, and such a decision cannot in any way be regarded as appropriate conduct.
The opinion has been submitted to the Prosecutor General's Office, said PSKUS representative Gundega Vārpa.
The previous board of directors of Stradiņš Hospital would be obliged to compensate for the damage suffered because the decision to terminate the contract unilaterally was not taken when the grounds for such a decision arose. The amount of damage caused is yet to be calculated.
The construction contract between PSKUS and Velve was terminated on Tuesday February 13 and the hospital expects to take over the new A2 Corps within five working days, until February 20; however, Velve has showed no initiative to leave the project.
