The Prosecutor General's Office said that the prosecutor's statement regarding the sentence in the so-called Ukrainian flag case was revoked. On the basis of a complaint from the representative of the victim, the sentence was re-examined. In the original sentence, the attacker was found guilty and punished with community service of 200 hours.
In the course of the examination, it has been concluded that the contested sentence of the public prosecutor must be waived as unfounded and that pre-trial criminal proceedings are renewable, since the statement was adopted without assessing and examining all facts, ancillary facts and facts obtained during criminal proceedings which relate directly to the correct legal qualification of the criminal offense, and the mitigating and aggravating circumstances.
“The content of the statements of the accused is also to be analyzed in the context of the alleged ethnic, national hatred and intolerance, as well as the gross crimes committed by the armed forces of the Russian Federation against peace and war crimes in Ukraine,” the prosecutor's office said in a statement to the media.
The renewed pre-trial criminal proceedings have been handed over to the Prosecutor General of Rīga, Pārdaugava.
