The officer, who is unnamed as is the norm at this stage of legal proceedings, is suspected of "exceeding the authority of the service, involving violence."
In the course of the pre-trial investigation, the Internal Security Bureau found out that the municipal police officer exceeded his official authority during the performance of his duties by unreasonably using violence against a private person, as a result of which the victim was injured.
Non-custodial security measures have been applied to the municipal police officer, including a ban on holding a specific position in the municipal police.
In connection with the violation allegedly committed by the municipal police official, a criminal proceeding has been handed over to the prosecutor's office with a proposal to initiate criminal prosecution for the commission of the criminal offense provided for in the second part of Section 317 of the Criminal Law - violation of official authority, which is related to the use of violence.
The IDB is a state administrative institution whose task is to detect, prevent and investigate criminal offenses committed by officials and employees of subordinate institutions of the Ministry of the Interior. Sometimes the agency is thought of as the police of the police, but in fact their remit is wider, taking in the prison service, border guard, fire and service, migration affairs office and other Interior Ministry instutions (excepting the State Security Service).
In 2023(see atachment), the Internal Security Bureau initiated 50 criminal proceedings within its competence and conducted a pre-trial investigation in 142 criminal proceedings in total. In the past year, the Internal Security Office sent 48 criminal proceedings to the Prosecutor's Office for the initiation of criminal prosecution for 98 criminal offenses against 72 persons - 56 officials and employees of the Ministry of Internal Affairs and municipal police institutions, as well as 16 natural persons.
